Why The Timing Matters

 
  • A 1031 exchange lets you defer capital gains tax when you sell real estate held for investment or business use and reinvest in other real estate held the same way.
 
  • It has to be set up before your sale closes. Once you receive the money yourself, it's too late. The sale proceeds must go to a Qualified Intermediary like 1031 Accommodators, not to you.
 
  • The clock starts the day you close: 45 days to identify replacement property in writing, and 180 days to complete the purchase. Neither deadline can be extended for ordinary delays.
 
  • Your home on the land? The house and the lot it sits on may qualify for a separate home-sale exclusion, while the extra acreage you hold for investment may qualify for a 1031 exchange. Both can apply in the same sale.
